Beacon Life Sciences LLC, operating under the name Beacon Clinical Registry (collectively, “Beacon,” “we,” “us,” or “our”), provides registration, data collection, patient reported outcome, workflow, communication, and related software used in clinical, research, regulatory, and business operations. These Terms of Use (“Terms”) govern access to and use of our websites, software, portals, forms, messaging programs, support channels, and related services (the “Services”).
By accepting these Terms or using the Services after being presented with them, you agree to these Terms. A person accepting for an organization must have authority to do so. Do not use the Services if you do not agree. Contact Beacon or the organization responsible for your program to discuss another available way to complete a required task.
These Terms address use of Beacon’s Services. They do not replace a study consent form, HIPAA authorization, healthcare provider notice, study protocol, or separate written agreement. Agreement to these Terms is not consent to research, treatment, marketing, or recurring SMS.
1. Scope and Our Role
The Services may be used by patients and study participants, parents and legal guardians, caregivers, physicians and investigators, clinical and administrative personnel, companies, research sponsors, partners, vendors, and regulatory or governmental contacts.
Beacon may operate Services for its own account administration and business activities or as a service provider, data processor, or HIPAA business associate for a customer. Where a customer controls a clinical program, study, or workflow, that customer remains responsible for its decisions, instructions, permissions, and applicable obligations.
The Services provide software and operational support. They are not an emergency service and do not replace professional medical judgment. Access to a portal or receipt of a message does not establish eligibility for a study, authorize a treatment, or guarantee access to a product or service.
2. Eligibility, Authority, and Use for Minors
You must be at least 18 years old and legally able to enter into these Terms to create an account independently or enroll in Beacon’s SMS program. Minors are not intended to create accounts or use the Services independently.
Parents, guardians, caregivers, healthcare professionals, research personnel, and other authorized adults may submit information concerning a minor or another person only within the authority granted to them and subject to applicable consent, authorization, assent, protocol, contractual, and legal requirements. A caregiver relationship alone does not establish authority for every action.
When acting for a participant, patient, or organization, identify your role accurately. You may not consent to messages being sent to another adult’s phone merely because you provide care or perform administrative work for that person. The intended message recipient must provide the required SMS consent.
3. Accounts, Verification, and Security
Provide accurate account and contact information, keep it current, and use only access permissions assigned to you. Protect your credentials and devices, do not share passwords or verification codes, and do not allow unauthorized people to use your account.
A verification code confirms a specific verification step. It is not a clinical credential, a study consent, or permission to access another person’s records. Report suspected unauthorized access, compromised credentials, or security concerns promptly to support@beaconcr.com.
Beacon may use verification, access restrictions, audit records, and other reasonable controls to protect the Services. No electronic system can guarantee absolute security.
4. SMS and Mobile Messaging Terms

A. Types of Messages
Depending on your request and consent, messages may include one time passcodes and identity verification messages; registration, account, invitation, and access notifications; assessment, visit, appointment, or task reminders; study, service, workflow, support, security, and operational status updates; and administrative, policy, or compliance notices.
These SMS terms cover informational communications only. They do not authorize promotional text messages, advertising by unrelated businesses, or campaigns offering medicines or investigational products for sale. A change in message purpose requires the applicable separate consent and review before that messaging begins.
B. Consent and Enrollment
Beacon sends recurring SMS only after you separately and affirmatively provide express written consent through the disclosed enrollment process. Simply providing a telephone number, accepting these Terms, creating an account, or participating in a study does not, by itself, enroll you in recurring SMS.
By selecting an SMS consent option presented to you, you authorize Beacon to send the described text messages, including messages sent using automated technology, to the mobile number you provide. You must be the subscriber or authorized user of that number and the intended recipient. Consent is specific to Beacon and the purposes presented at enrollment.
Consent to recurring SMS is voluntary and is not a condition of purchasing a product or service. Contact your program team or Beacon about available alternatives. Beacon maintains records of consent, the enrollment method, and requests to withdraw consent.
C. One Time Verification and Messages You Initiate
When you specifically request a verification code or choose a verification process that clearly discloses SMS delivery, Beacon may send the requested verification message. This request does not enroll you in recurring reminders or promotional messages.
When you initiate a support message, Beacon may respond within that requested exchange, subject to your consent status and applicable messaging requirements. A support exchange does not create ongoing SMS consent. A previous unsubscribe instruction is not overridden merely because you continue using the website or your study account.
D. Message Frequency and Charges
Message frequency varies based on your activity, the services requested, and the applicable program. Verification messages are sent in response to your requests rather than on a recurring schedule.
Message and data rates may apply to messages you receive and send. Your wireless provider determines the charges under your plan. Contact your provider with questions about your text messaging or data plan.
E. How to Unsubscribe
You may withdraw SMS consent at any time by replying STOP to a message from the program. You may also request assistance with opting out by contacting info@beaconcr.com or +1 307 285 6336. Beacon will honor other clear requests to stop messaging as required by applicable law.
After you opt out, you may receive one final text confirming that your request has been processed. No further program messages will be sent unless you subsequently provide fresh express written consent through an authorized enrollment process. Beacon will not use a different sending number to bypass your choice.
Unsubscribing from SMS does not itself close your account, withdraw you from a study, revoke a research consent or HIPAA authorization, or request deletion of records. Contact the responsible organization to make those separate requests. SMS reminders and other features that depend on text messaging will no longer be available while you are unsubscribed.
F. How to Rejoin
To resume recurring messages, enroll again through the program’s SMS consent process and provide fresh express written consent. Contact Beacon for assistance when needed. A new phone number, login, or appointment does not automatically restore consent after an unsubscribe request.
G. How to Get Help
Reply HELP to a program message for assistance, email info@beaconcr.com, or call +1 307 285 6336. Use email or telephone if a text cannot be delivered. Contact your healthcare professional or study team for questions about care, study participation, or clinical instructions.
H. Mobile Privacy and Sensitive Information
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Beacon does not sell, rent, or transfer SMS consent. Mobile information, SMS enrollment records, and other personal information are subject to the protections described in the Privacy Policy. These Terms do not expand the sharing permitted by that Policy.
Beacon does not intend to include detailed diagnoses, treatment information, assessment responses, or other highly sensitive clinical content in ordinary SMS. Text messages may not be encrypted from sender to recipient and can appear on a device’s lock screen or be visible to others with access to the device. Do not text passwords, verification codes, detailed medical records, or other sensitive information to support staff.
I. Delivery, Carriers, and Number Changes
SMS availability depends on your device, wireless provider, coverage, and other technical conditions. Delivery and timing are not guaranteed. Carriers are not liable for delayed or undelivered messages. This statement does not limit rights or liabilities that applicable law does not allow to be limited.
Keep your mobile number current and notify Beacon before giving up or transferring a number enrolled in the program. Do not rely on an SMS reminder as the only record of an appointment, assessment, or deadline.
J. No Emergency or Urgent Medical Use
Do not use SMS or the Services for emergencies or urgent medical needs. Call 911 in the United States or the appropriate local emergency service. Contact your treating healthcare professional or study team through its designated channels for clinical concerns.
5. Privacy, Information You Submit, and Records
Our Privacy Policy explains how information is collected, used, disclosed, retained, and protected. Submit information only when you have the necessary authority, permission, consent, or other lawful basis. Provide accurate responses to the best of your knowledge and use the designated correction process when a record needs to be corrected.
You authorize Beacon to process submitted information only as permitted by the Privacy Policy, applicable law, and relevant customer instructions and agreements. These Terms do not grant Beacon unrestricted ownership of personal or clinical information or permission to use it for unrelated advertising.
Closing an account or stopping SMS does not automatically delete clinical, research, regulatory, or consent records. Retention, correction, access, and deletion requests may be subject to applicable law, customer responsibilities, and recordkeeping requirements described in the Privacy Policy.
6. Clinical Research, HIPAA, and Regulated Activities
Clinical and research decisions remain with the responsible healthcare professionals, investigators, sponsors, institutions, and oversight bodies. Information provided through the Services is not a substitute for their advice, instructions, or required review.
When Beacon processes protected health information as a business associate, the applicable Business Associate Agreement and HIPAA requirements govern that processing. These Terms are not a HIPAA Notice of Privacy Practices, an informed consent document, or a treatment authorization.
Each organization using the Services is responsible for the approvals, consents, credentials, permissions, and oversight required for its activities. Access to software, an electronic acknowledgment, or a platform record does not by itself establish regulatory approval, study approval, or compliance with a particular electronic record or signature requirement.
These Terms do not waive a participant’s legal rights or release, or appear to release, an investigator, sponsor, institution, or its agents from liability for negligence. Study withdrawal, questions about participation, and reporting of clinical concerns should follow the applicable study documents and the responsible study team’s instructions.
7. Acceptable Use
Use the Services only for lawful purposes within your assigned role and permissions. You may not access another person’s records without authority, impersonate another person, falsify clinical or regulatory information, interfere with audit records, circumvent security controls, introduce malicious code, or disrupt the Services.
Do not use the Services to send unsolicited messages, upload purchased messaging lists, share SMS consent with another business, harass others, distribute unlawful content, or collect data beyond your authorized purpose. Automated extraction, security testing, or system access beyond your permissions requires Beacon’s prior written authorization and must comply with applicable law.
8. Intellectual Property and Authorized Access
Beacon and its licensors retain their rights in the software, website design, trademarks, documentation, and other materials they provide. Subject to these Terms and any applicable agreement, you receive a limited permission to use the Services for their intended purpose within your authorized role.
You may not reproduce, redistribute, resell, or modify proprietary materials beyond the permissions granted or what applicable law allows. Clinical instruments and other licensed materials may have separate use restrictions. These restrictions do not remove any lawful right to obtain your own records or exports you are authorized to receive.
9. Third Party Services and Links
The Services may link to or integrate with independently operated websites, applications, platforms, or services. Those providers may have their own terms, privacy notices, and security practices. Review the applicable terms before providing information directly to them.
A link or integration does not itself mean Beacon endorses a provider, product, or treatment. Beacon remains responsible for obligations concerning its own service providers to the extent required by applicable law or contract.
10. Fees and Separate Agreements
Any fee, subscription, cancellation, refund, or payment obligation for a paid Service must be disclosed in the applicable order, checkout, or separate agreement. These Terms alone do not create a purchase or authorize a charge. Wireless provider message and data charges are addressed in Section 4.
A separate signed customer agreement governs the Services it covers if it conflicts with these general Terms, subject to applicable law. No such agreement substitutes for the individual consent required for SMS or reduces applicable participant, privacy, or consumer rights.
11. Service Availability and Disclaimers
Beacon may maintain, update, or change the Services. Except for express commitments in a separate agreement and obligations that cannot lawfully be excluded, the Services are provided as available. Beacon does not promise uninterrupted operation, error free content, or continuous delivery of notifications.
Technical outputs, reminders, forms, and workflow status information may require review or confirmation by the responsible organization. The Services do not guarantee enrollment, treatment access, regulatory acceptance, or clinical outcomes. Required professional, regulatory, privacy, and contractual obligations remain in effect.
12. Responsibility and Preservation of Rights
Each party remains responsible for its own conduct and obligations under applicable law. To the extent the law permits, Beacon is not responsible for losses caused solely by your unauthorized use or by an independent third party outside Beacon’s control, except where Beacon has a legal or contractual duty concerning that conduct.
Nothing in these Terms excludes liability for fraud, willful misconduct, gross negligence, or liability that cannot lawfully be excluded. Nothing restricts required privacy or security obligations, mandatory consumer protections, or the research participant protections in Section 6. Any limitation applies only to the extent permitted by applicable law.
13. Suspension and Ending Access
Beacon may restrict or suspend access when reasonably necessary to address unauthorized activity, a security risk, a material breach of these Terms, a legal requirement, or a lawful instruction from the organization responsible for an account. Where appropriate and permitted, Beacon will provide notice and an opportunity to address the issue.
You may stop using the Services or contact Beacon about closing an account. Ending platform access does not itself withdraw you from a study, terminate healthcare services, cancel a separate contract, or erase records. Applicable record access, retention, transition, and other continuing obligations remain in effect.
14. Applicable Law and General Provisions
The Services must be used in accordance with applicable law, including requirements that apply to your location and the relevant clinical, research, or business activity. These Terms do not remove mandatory rights or protections available under applicable law.
Contact Beacon using Section 16 to raise a concern. This contact process is not a prerequisite to exercising legal rights or contacting a regulator. If a provision cannot be enforced, the remaining provisions will continue to apply to the extent permitted by law. A delay in enforcing a provision does not waive it.
15. Changes to These Terms
Beacon may update these Terms to reflect changes in the Services, technology, legal requirements, or business practices. The revised Terms will identify their last updated date. Beacon will provide additional notice of material changes when required by law or otherwise appropriate and obtain acceptance or consent when required.
Posting revised Terms does not create SMS consent, restore withdrawn consent, or authorize new message purposes. A material change to the SMS program will be implemented only with any notice, consent, and messaging review required for that change.
